Permite a sus solicitantes trabajar y residir en España al acreditar que se ha realizado una inversión significativa de capital en el país
En septiembre de 2013 el Gobierno español aprobó una ley que tenía por objeto otorgar la posibilidad de residir en España a ciudadanos extranjeros extracomunitarios. Para ello, el Gobierno creó un instrumento denominado golden visa o residencia por inversión.
La golden visa permite a sus solicitantes poder trabajar y residir en España junto con su familia al acreditar que se ha realizado una inversión significativa de capital en el país y que se cumplen con el resto de los requisitos previstos en el ordenamiento jurídico español.
Para disfrutar de los beneficios que ofrece el Programa Golden Visa, es necesario el cumplimiento de los requisitos previstos en los artículos 62, 63 y 64 de la Ley 14/2013, entre los que se encuentran haber realizado una inversión de 500.000 euros (más impuestos) en bienes inmuebles, muebles y/o proyectos empresariales de interés general. En relación con los bienes inmuebles, dicha inversión puede englobar más de un inmueble.
Así mismo, es requisito indispensable carecer de antecedentes penales en España y no haber cometido ningún delito previsto en el ordenamiento jurídico español en los países donde haya residido el inversor durante los últimos 5 años.
De esta forma, solamente será obligatorio entregar el certificado de antecedentes penales, certificados que deberán estar debidamente apostillados o, en su caso, legalizados para que dicho documento tenga validez ante las autoridades españolas. En los casos en que el certificado haya sido expedido en un idioma distinto del español, este ha de ser traducido por un traductor jurado.
Asimismo, esta modalidad de visado incluye el permiso de trabajo para el inversor y sus familiares sobre la base del artículo 65 de la referida ley, entendiendo así que la concesión del visado de residencia para inversores constituirá título suficiente para residir y trabajar en España durante su vigencia.
Por último, y en comparación con otras autorizaciones de residencia, el periodo de vigencia de la Golden Visa será inicialmente de dos años, tras los cuales se podrá solicitar su renovación por periodos sucesivos de cinco años.
